On the same day, Li and his family took a plane from Boston, USA via Los Angeles and returned to China by plane.
In June 2020, the People’s Procuratorate of Shunyi District, Beijing approved the arrest of the criminal suspect Li Mou on suspicion of obstructing the prevention and control of infectious diseases. The report stated that when the nucleic acid test result did not come out, Li and her husband and their young son took a plane from Boston, USA to Los Angeles, and returned home on Air China Flight CA988. In order to board the plane smoothly, Li took anti-fever medicine to lower his body temperature before departure. After boarding the plane, Li did not take the initiative to truthfully declare fever and other uncomfortable symptoms, and did not truthfully answer the flight attendants’ inquiries about epidemic prevention and control. On March 13, Li and others arrived in Beijing. On that day, Li was diagnosed with new coronary pneumonia, and more than 60 people in close contact with him were quarantined. On March 16, Li’s husband was diagnosed with new coronary pneumonia.
The verdict shows that in order to board the plane smoothly, Li Mou took anti-fever medicine to lower her body temperature before boarding the plane and passed the temperature test. After boarding, when the flight required passengers to proactively declare fever and other uncomfortable symptoms, Li did not declare and did not truthfully answer the crew’s inquiries about the epidemic prevention and control such as physical condition, contact history, and accompanying personnel.
Before the plane landed, Li Mou truthfully filled out the”Exit/Entry Health Declaration Card” and informed the crew of his condition and medical treatment. On March 13, Li and his family arrived in Beijing, and the epidemic prevention department sent him to a doctor for treatment. Li was diagnosed with a new type of coronavirus pneumonia that day, and 63 of his close contacts were quarantined. The defendant Li was later seized.
The court held that the defendant Li had violated the provisions of the Law on the Prevention and Control of Infectious Diseases by failing to abide by the prevention and control measures proposed by the customs and civil aviation authorities when returning from abroad on a Chinese aircraft, and falsely reported and concealed his illness and contact history. As a result, more than 60 people were quarantined for observation, causing a serious risk of the spread of the new coronavirus. Their behavior has constituted a crime of hindering the prevention and control of infectious diseases and should be punished.
The court held that abiding by the relevant regulations on epidemic prevention and control, filling out the health declaration card truthfully, and cooperating with epidemic prevention personnel are the obligations of every citizen in this special period of epidemic prevention and control. Li’s related behaviors It does not reflect the willingness to surrender to the law and does not automatically surrender, so it does not constitute surrender.
